Pune Porsche Incident: Police Submit Report to JJB, Chargesheet to Follow Soon

Pune, 18th July 2024: A case was registered against a minor accused of driving his Porsche car while drunk and speeding, resulting in the deaths of two people in Pune’s Kalyani Nagar. A report regarding the incident has now been submitted to the Juvenile Justice Board (JJB). Many statements have been recorded, and a supplementary report will be submitted soon. Police reports indicate that the investigation is almost complete, and a chargesheet will be filed shortly.

On Friday (19th July), the Kalyani Nagar Porsche accident will mark two months. In this incident, the minor accused, along with his family and others, were arrested. The minor accused and his grandfather have been granted bail. His grandfather, Surendra Kumar Agarwal, was arrested for kidnapping and criminal intimidation of the family driver to take the minor’s crime upon himself. His father, Vishal Agarwal, and mother, Shivani Agarwal, were arrested for tampering with blood sample evidence, along with employees of Sassoon General Hospital and others.

Additionally, Pune Police have been seeking to try the minor accused as an adult. The process typically takes 60 to 90 days, after which a decision is made. To try a minor as an adult, the police must apply with the JJB, which is then reviewed by a committee.

Section 15 of the Juvenile Justice (Care and Protection of Children) Act of 2015 states that if a minor aged 16 to 18 years has committed a heinous offense, they can be sent to a Criminal Court.

Until now, 14 accused have been arrested in the Kalyani Nagar Porsche incident, with 7 having been granted bail. Those granted bail include the minor accused, his grandfather Surendra Kumar Agarwal, Cosie Pub owner Naman Bhatuda, operator Sachin Katkar, BLAK Pub owner Sandeep Sangale, BLAK employee Nitesh Shevani, and BLAK bar counter employee Jayesh Gavkar. The pub-related individuals were arrested for serving alcohol to the minor without verifying his age. The minor consumed alcohol before killing the IT engineer duo in Kalyani Nagar.

Currently, the accused housed in Yerawada Jail include the minor’s father Vishal Agarwal, mother Shivani Agarwal, Sassoon Hospital Dr. Ajay Taware, Dr. Shrihari Halnor, peon Atul Ghatkamble, Ashpak Makandar, and Amar Gaikwad. All these individuals were arrested in connection with swapping the minor’s blood sample to tamper with evidence, attempting to save him from the driving under the influence case.

Agarwal family lawyer Adv Prashant Patil said, “While the minor and his grandfather have been granted bail, the bail application of Vishal and Shivani Agarwal is pending. Vishal Agarwal has been granted bail in some cases filed after the accident. He is currently in judicial custody in the blood sample tampering case. The crime is still under investigation.”

The accused are being interrogated for the issues that remain to be investigated. Some new statements have been recorded in the case against the child, and a supplementary chargesheet is being filed. The crime has also been escalated. An application has been made to the JJB to declare the child as an adult.”
