Pune: PMC Demolishes Baner Society’s Play Area and Compound Wall: Residents Allege Misuse of Law

Baner, 21st April 2023: Residents of the Yash Twin Tower society in Baner, Pune, are in distress after the Pune Municipal Corporation (PMC) entered the society premises with heavy police force on April 17 to demolish the kids’ play area and compound wall.

According to the society residents, the matter was already in court since June 2022, but the officials denied showing any documents regarding the order for the action. The officials arrived with bulldozers, tractors, and other security forces, breaking the kids’ play area and compound wall and manhandling and misbehaving with the residents, including females.

The residents are now facing many security and safety issues due to the illegal demolition by the civic body. The owners of adjoining plots also tried to enter the society along with goons on the same day of the demolition, and when opposed by the society members, they threatened and physically abused them. The next day, a snake entered the society from the broken compound wall, creating panic among kids and senior citizens.

The residents received possession of their flats in 2019 after receiving the Occupancy Certificate. However, the builder and others revised the PMC plan without the flat owners’ consent to provide a road to adjoining plots, which is a clear violation of the MahaRERA and Maharashtra Ownership Flats Act (MOFA) rules. When the society members came to know about it after 2.5 years, they immediately filed a case against PMC and other involved parties for illegally sanctioning the plan.

Despite the matter being sub judice, the PMC officials came with a team to destroy the property without waiting for the court verdict. This has caused immense emotional and physical distress and an additional financial burden on society members. The Chairman of Yash Twin Tower, condemning the action taken by the PMC, called it illegal and a misuse of law.

The society plans to take action against those involved in the illegal act, and they have approached the court to present their case.

According to PMC Executive Engineer Shrikant Waydande, the society in question was previously issued a notice by the department. However, after receiving the notice, the society members decided to take the matter to court. Despite this, the court has not yet issued any orders regarding the issue. As a result, the PMC has taken action based on the original notice that was previously issued, as they have not received any further instructions from the court.
