Pune: Negligence By Doctors And Nurses Results In Newborn’s Death; Court Sentences Them To Two Years Imprisonment

Pune, 20TH July 2023: In a tragic incident that occurred on November 29, 2010, a newborn lost their life due to the negligence of medical professionals at Aundh General Hospital during the delivery process. As a result of the inquiry into the case, two doctors and three nurses have been held accountable for their actions and have each been fined Rs 50,000, in addition to receiving a two-year sentence of simple imprisonment.

A compensation amounting to one lakh rupees has been ordered to be paid to the grieving mother by First Class (Judicial Magistrate) NR Gajabhaye.

The convicted medical personnel are identified as Dr Arpita Pradeep Bawarkar, a Gynecologist at Aundh General Hospital, Dr Atmaram Venkatarao Shejul (48), Nurse Manisha Bhalchandra Joshi, Nurse Ujjwala Dattatray Nagapur and Nurse Shubhangi Ramchandra Kamble.

The case came to light when Bhagwan Daulat Wakode, the driver of Aundh Hospital, lodged a complaint at Sangvi Police Station, seeking justice for the tragic loss of his daughter, Manisha Nilesh Oru, a resident of Keshavnagar.

The incident took place on 29th November 2010. Manisha Oru was admitted to Aundh Hospital for delivery while experiencing abdominal pain. Despite reporting her discomfort to Dr Bawarkar and Dr Shejul, her condition was overlooked, and the nurses failed to communicate the matter to the doctors. Tragically, Manisha’s baby did not survive the delivery due to the negligence of the medical team, leading to the registration of a case against the accused.

The police conducted a thorough investigation, gathering technical and circumstantial evidence related to the incident, and subsequently filed a charge sheet in the court. Following the court’s proceedings, the accused were found guilty and have been sentenced accordingly.

In addition to the imposed fines and imprisonment, the court has ordered the convicts to provide compensation of one lakh rupees to the complainant, Manisha Nilesh Oru, as a measure to address the immense loss she endured.
