Pune: Court Orders PMC To Pay Compensation Of Rs 16 Lakh To Family Of Man Who Died Due To Pothole
Pune, 3rd January 2023: SS Shinde, Senior Civil Judge of Shivajinagar District Sessions Court, ordered the Pune Municipal Corporation (PMC) to pay Rs 16 lakh and 16 per cent interest as compensation to the family of a young man who died in an accident after falling from his two-wheeler due to a pothole.
Yash Dinesh Soni (20) died in an accident when his two-wheeler fell after falling into a pothole. His father, Dinesh Phulchand Soni (52), a resident of Aurangabad, had filed a civil suit against the Pune Municipal Corporation. In this claim, he demanded compensation of Rs one crore from the corporation.
Yash was on his way to Shivajinagar Court from Sancheti Hospital Chowk on 26th June 2016. There was a big pit in the area of Shivajinagar Court. Yash lost balance due to the pit. The iron rod placed on the divider entered Yash’s chest, and he died on the spot in the accident.
“The Municipal Corporation is responsible for keeping the roads in good condition by properly maintaining the public roads. Yash died due to a partially cut iron rod as the municipality failed to fulfil its responsibility.” In the suit filed, Soni demanded that the municipal corporation pay a compensation of Rs one crore for being responsible for the accident.
It was claimed on behalf of the municipal corporation that the two-wheeler Yash was driving at high speed and lost control and hit the divider.
After hearing the arguments of both sides, the court ordered that the Municipal Corporation should pay compensation of Rs 16.20 lakh to the family of Yash, as well as the funeral expenses of Rs 15,000 with 16 per cent interest from the date of filing the suit.
The iron rod is not kept in the proper position. It is the responsibility of the Municipal Corporation to maintain it. The Municipal Corporation has not fulfilled its responsibility. The court held the municipal corporation accountable for the accident.
