PUNE COURT ORDERS FOR REINVESTIGATION IN A CRIMINAL CASE

PUNE, 02/09/2024: In a significant and exceptional development in the ongoing case involving Kadka Karansingh and Abdul Hamid Jafri of Pune, the Court of JMFC, Pune has formally decreed the initiation of a comprehensive reinvestigation pursuant to the protest petition filed by the brothers Ravi and Raju Thadaney through their Counsel Advocate Aashuutosh Srivastava challenging the NC summary report submitted by the Bund Garden Police Station, Pune before the JMFC, Pune. This order stipulates that the relevant authorities are to undertake a thorough review and re-examination of the matter at hand, in light of the contentions raised in the protest petition which has been filed before the Judicial Magistrate First Class (JMFC) in Pune. The petition, submitted by Advocate Srivastava on behalf of the Thadaney family, seeks a reinvestigation of FIR registered in Bund Garden Police Station in Aug 2021.

The petition seeks to contest the prior decision that emerged from the Investigating Officer’s ‘C’ Summary Report. This report, which was submitted at the behest of Bundgarden Police Station in Pune, recommended that no further action be taken regarding the matter under investigation. In the petition filed by Thadaney, it is argued that the initial investigation was marred by substantial procedural shortcomings and oversights. Consequently, the petitioners assert that these deficiencies necessitate a thorough reevaluation and rectification to ensure justice is properly served.

The issue was initially referred to the Bombay High Court by the Thadaney brothers through their counsel Adv. Aashuutosh Srivastava which had ordered for the submission of the Affidavit by the Deputy Commissioner of Police regarding the detailed investigation of the case and thereafter realizing that the NC Summary report was submitted before the JMFC, refered the matter to JMFC Pune by giving liberty to the Petitioners. Thereafter, on approaching JMFC Pune, Justice J. Koinkar, reviewed the petition after the final arguments and submissions and vide Order dated August 29, 2024, concluded that the initial investigation had indeed revealed lacunae. Consequently, the court rejected the non-cognizable (NC) report and ordered a fresh investigation into the case.

This development marks a critical juncture in the legal proceedings against the accused in the light of illegal trespass, criminal intimidation, and related offences. The court’s decision to reject the NC report and mandate further investigation underscores the seriousness of the allegations and the ongoing quest for justice. As the case moves forward, the Thadaney family and their legal representation remain committed to ensuring that the allegations are thoroughly investigated and that appropriate legal action is taken.
