NEET UG Exam Stands Valid, No Re-Exam Now: Supreme Court

New Delhi, 23rd July 2024: The Supreme Court today completed its hearing on the NEET UG case, taking into account the report from IIT Delhi. Chief Justice D.Y. Chandrachud noted that based on the evidence and data presented, there was no indication of a systematic leakage of the question paper, thus preserving the integrity of the examination.

Given these findings, the Supreme Court decided it would not be justified to conduct the NEET examination again and refused to order a re-exam. The Chief Justice stated, “On the basis of the material and data presented before us, there is no indication of systematic leakage of the question paper, which indicates a disruption in the sanctity of the examination.”

During the hearing, senior lawyer Sanjay Hegde, representing the petitioners, argued that students had received the paper on May 4, memorized the correct answers, and still failed. He emphasized that a significant timeline is necessary for a paper leak, suggesting that it could not have occurred in a short period.

Addressing this, Chief Justice Chandrachud proposed a solution for the controversial Physics question. He suggested awarding full marks to students who marked option 4 as the correct answer and not deducting marks from those who selected option 2.

The court referred to the report from IIT Delhi, presented during the hearing. Earlier, a bench comprising Chief Justice Chandrachud and Justice JB Pardiwala had asked IIT Delhi to form a team of three subject experts to examine the contentious Physics question and submit a report by Tuesday afternoon.

CJI Chandrachud said, “We have received the report of IIT Delhi. IIT Director Rangan Banerjee formed a committee of the Physics Department, and they determined that option 4 is the correct answer.”

With this ruling, the Supreme Court has upheld the NEET UG examination results, maintaining the examination’s validity and addressing the concerns raised by the petitioners.
