IT Companies Deduct Salaries Of COVID Infected Employees, NITES Appeals Maharashtra Govt To Intervene

Pune, November 16, 2020: During this critical period of COVID19 pandemic when Central and State governments are trying to protect the employment and wages of the employees; various IT/ITeS/BPO/KPO companies and its management are in complete defiance of the mandatory legal provisions & have acted illegally by deducting salaries of employees who were quarantined or affected by Coronavirus disease (COVID19).

Nascent Information Technology Employees Senate (NITES), which is working for welfare and benefits of IT/ITES and its related sector employees, has requested Chief Minister Uddhav Thackeray and Labour Minister Dilip Walse-Patil to issue an advisory to all employers regarding below issues:

1. The period of Quarantine of Employees/Workmen infected by Coronavirus shall not be treated as unauthorized absence

2. Employers should enable the Employees/Workmen infected by Coronavirus to utilize leaves under their Quota for the period of quarantine.

3. The Employees/Workmen who are not coming under the purview of ESIC, even if they are not entitled to leave, if infected by the coronavirus, taking into consideration the larger interest of society, to be granted leave as available/possible, in term of their employment to undergo quarantine.

4. Incase Employee who does not have leave under their quota and when it is already fully utilized, employers advised to provide for advance leave which the Employees are eligible to avail in the future so that the infected Employee/Workmen may undergo quarantine.

5. When the Employers are unable to grant leave on their own initiative to Employees and such Employees do not have any kind of leave under their Quota, both Employer and Employees to consult with each other regarding granting of special leaves for the period and come to an amicable solution. We urge the State Government to look and implement policies for the same. It is our fervent hope that such violations do not occur in future and the working conditions of the employees will improve at a faster pace.

NITES president Harpreet Saluja said, “We have received acknowledgement from the Chief Minister’s office about our petition demanding advisory regarding grant of quarantine leave to employees affected by Coronasirus disease COVID19. We hope that affected employees will get relief.”
