Hathras Case: CBI Confirms Gang Rape of the Dalit Girl; Charged The Four Accused Of Gang Rape And Murder

Lucknow, December 18, 2020: The Central Bureau of Investigation (CBI) today filed a charge sheet in the case of death after the gang rape of a Dalit girl in Hathras, Uttar Pradesh. The four accused in the charge sheet have been convicted of gang rape and murder. Counsel for the accused Munna Singh Pundhir said that the four accused, Sandeep, Lavkush, Ravi and Ramu, have been charged with rape and murder by the CBI. The lawyer said that the CBI has also made allegations against the accused under the SC/ST Act.

The CBI has made the victim’s last statement the basis of the charge sheet. The lawyer said that the CBI has filed a charge sheet against the four accused in the case under sections 325-SC/ST Act, 302, 354, 376A and 376D of the Indian Penal Code. The four accused lodged in the Aligarh jail were taken to Gujarat last month and had their brain mapping test done. A polygraph test and bios profiling of the accused were also conducted. The CBI had received its report a week ago.

The victim’s brother will have a psychological test

The CBI will also take the victim’s brother to Gujarat for a forensic psychological test. In the Hathras case, the FIR was filed by the victim’s brother. If sources are to be believed, the CBI needs precise answers to some questions. Therefore, the victim’s brother is undergoing a psychological assessment. In this way, direct and indirect questions are asked during the questioning. The entire process is recorded.

The court had summoned the DM of Hathras Praveen Kumar and SP Vikrant Veer on December 16, the court fixed the next date of hearing on 27 January. The victim’s family will also be present in the court. However, no order has been given by the court as yet about giving houses and jobs to the victim’s family. Seema Kushwaha, advocate for the victim’s family said, “Hathras DM was responsible for providing compensation to the victim’s family, but nothing has happened so far.”

The incident took place on September 14 in Hathras, Uttar Pradesh where a Dalit girl was allegedly gang-raped by some youths. The girl was also assaulted. She was admitted to Safdarjung Hospital in Delhi in a critical condition where she died on 29 September.

Police had performed the funeral overnight after the death of the victim at Safdarjung Hospital. The police took the body of the victim to her village at night and performed the last rites in the absence of the family. CM Yogi Adityanath recommended a CBI inquiry into the incident after the Uttar Pradesh government was questioned.

The CBI started an investigation into the Hathras case on 11 October. So far, more than 50 people, including the victim and the family of the accused have been questioned. An eye witness known as Chotu who claimed to be the first to reach the spot has also been questioned several times. A scene map was also created with scene re-creation.
