Pune IT Professional Seeks Legal Action After Unpaid Salary and PF Contributions

Pune, 10th June 2023: After working for the same company for seven years, I had hoped for a smooth transition when resigning from my job. However, I have yet to receive my three months’ salary, gratuity, provident fund (PF), and full and final settlement, totaling Rs 18,73,000. Rajnish Kumar expressed his disappointment at having to go through the labor commissionerate, police, and court processes to resolve this issue.

Kumar had been employed at a reputable company in Pune with a workforce of 450 employees. Due to personal reasons, he resigned from the company on November 3, 2022. As he prepared to leave, he checked the status of his PF and discovered that his contributions for the past five months had not been deposited. Upon raising the issue with the company, he was promptly terminated.

Having not received his three months’ salary, gratuity, PF, and full and final settlement, Kumar filed a complaint with the labor department. The company was called for three meetings to address the matter, but each time, their representative failed to appear. Frustrated, Kumar approached the police, but his complaint was not registered. Consequently, he filed a private complaint in court, and a recent verdict has ordered the registration of a case and a subsequent investigation into the matter.

“I resigned from the company due to personal reasons, but after discovering the confusion surrounding my PF, I inquired about it. Instead of responding to my inquiry, I was terminated. Furthermore, I am owed a total of Rs 18,73,177 by the company. Feeling cheated, I sought legal recourse,” shared Rajnish Kumar, an IT professional.

“Instances where employees’ PF contributions are deducted from their salaries but not deposited into their accounts are unfortunately prevalent in IT companies. In Kumar’s case, we provided assistance, following up on the matter and ultimately filing a court case,” stated Harpreet Saluja, President of the Nascent Information Technology Employees Senate, an organisation for IT employees.
