Pet Owners Need To Be Concerned About Safety Of Others: Court Says As It Sentences Dog Owner To Three Months

Mumbai, 6th February 2023: A magistrate’s court refused to grant relief to a businessman, explaining that pet owners must take responsibility for the safety of others. The businessman’s pet dog bit his 72-year-old relative three times 13 years ago, leaving him bleeding profusely. In this case, the court sentenced the businessman to three months.

The complainant was attacked and bitten three times by an aggressive dog. Proper care should have been taken while taking the dog for a walk in a public place. The accused did not exercise due care when taking his pet dog outside, which can be dangerous to others. Therefore, the question of showing mercy to the accused does not arise in such cases, the court said while convicting the businessman.

The accused knew that the dog became aggressive while opening the car door. Even after that, he opened the car door without any care. As a result, the dog attacked the complainant and bit him three times. This was also mentioned by the court while denying relief to the accused.

The complainant Kersi Irani, her son Hormus who was with her at the time of the incident, the doctor who treated Irani, the veterinarian who examined the Rottweiler and the investigating officer testified against the accused. Meanwhile, accused Cyrus Percy Hormusji (44) claimed that the dog was not his.

However, the court noted the testimony given by the veterinarian. The vet had testified that on 2 June 2010, Hormusji came to the hospital with a letter from the Malabar Hill Police Station for a general examination of the dog. According to the testimony of this vet, the dog belongs to the accused. While convicting the accused, the court also stated there is no reason for the veterinarian to give false testimony against the accused.
